KMT Demonstrates Greater Assertiveness against DPP’s Controversial Nomination List for Control Yuan

[June 29, 2020] The Kuomintang (KMT) Legislative Yuan Party Caucus has been filling the Legislative Chamber through its own members yesterday, June 28, in order to object President TSAI ng-wen’s controversial list of the Control Yuan Member nominees. The KMT firmly requests that President TSAI, who is also the Chairwoman of the Democratic Progressive Party (DPP), withdraw her nomination immediately, and to replace those who are not suitable on the list. President TSAI's obstinacy and the DPP’s “tyranny of the majority” at the Legislative branch have left the KMT with no option, but to control the Legislative Yuan’s chamber for a direct protest against her inappropriate, preposterous and arrogant nomination, unwillingness to communicate, and disrespect of the Republic of China (ROC) Constitution and the Control Yuan.

The Control Yuan is one of the five branches in the central government of the ROC, commonly known as Taiwan, that ought to remain independent and impartial to exercise the powers of impeachment, censure and audit. The decision of the KMT, the largest opposition party in the ROC (Taiwan), to block accesses to the Legislative Chamber is aimed mainly at protesting against the nomination of CHEN Chu, former Presidential Office Secretary-General and former Kaohsiung City Mayor, who is to head the Control Yuan. Such a nomination is inappropriate and preposterous!

CHEN has been an important DPP member and close ally of President TSAI for a very long period of time. CHEN’s close staff at the Kaohsiung City have an obvious record of corrective measures and impeachments by the Control Yuan. Both factors have deepened the KMT’s and the general public’s concern about CHEN to be in charge of the Control Yuan. The KMT opposes this Control Yuan nominee list that is full of political cronyism and obvious partisan considerations because nominating these politicians will pose serious question on the credibility and impartiality of the Control Yuan.

According to Article 7 of the “Additional Articles of the Constitution of the Republic of China”, “Members of the Control Yuan shall be beyond party affiliation and independently exercise their powers and discharge their responsibilities in accordance with the law.” However, nearly 90% of the nominee list are in some way affiliated with the DPP, thus showing obvious political cronyism. For example, the list includes LIN Kuo-ming (林國明) – president of the TSAI Ing-wen National Lawyers Support Association during the 2020 Presidential election and also brother of LIN Feng-cheng (林峯正), currently Chairperson of the Ill-gotten Party Assets Settlement Committee under the Executive Yuan, LIN Yu-rong (林郁容) – one of the founders of the New Power Party, SHI Jing-fang (施錦芳) – Deputy Chair of the Ill-gotten Party Assets Settlement Committee, as well as many former DPP legislators and officials. The DPP, having called for the abolishment of the Examination Yuan and the Control Yuan many times, has now changed its own principle once its position has changed, and has attempted to “privatize” this country’s governing function to the fullest.



Furthermore, the highly contentious nature of CHEN’s nomination for the president of the Control Yuan has led to the KMT’s assertive action yesterday. CHEN’s political affiliation has been too strong. Even though she has declared to withdraw from all DPP operations, it cannot change the fact that she was once and still is one of the elders of the DPP’s factions. Earlier on this year, the Control Yuan proposed corrective measures to the Kaohsiung City explosion incident that happened when CHEN was Kaohsiung City mayor, whereby more than NT$ 4 billion of private donations were not devoted fully to the relief of the victims, but rather to administrative affairs, blatantly violating the “Disaster Prevention and Protection Act.” To ensure the Control Yuan will function as it is, nominating CHEN as the head of the Control Yuan is the worst, as well as the most partisan, decision made by President TSAI.

The DPP ridiculously call out to the KMT to play the role of a rational opposition party. During President MA Ying-jeou’s 8 years in power, the DPP legislators had occupied the Chairperson’s podium in the Legislative Chamber nearly a hundred of times. The DPP as an opposition party at the time paralyzed the Legislative Yuan, including locking the Legislative Chamber’s gates and damaging public properties, and therefore disabled the legislative functioning. The KMT wants the DPP to recall what the DPP had done before and honor and protect the right of any opposition party valuing its responsibility at the Legislative Yuan and vowing to make sure the Control Yuan will be able to undertake the function of impeachment, censure and audit in a fair and professional way.

Regarding the DPP Legislative Caucus Whip KER Chien-ming’s statement that no one has opposed Control Yuan nominee lists in such a manner before, the KMT refutes it by indicating that, on June 25, 2014, the DPP legislators did exactly the same thing to object President MA’s nomination of the Control Yuan members. The DPP should reflect on its past behavior before criticizing others.

Since President TSAI does not want to communicate with the KMT and since the DPP’s “tyranny of the majority” at the Legislative Yuan will prevail once the extraordinary meeting session begins – which is scheduled for today (June 29). Therefore, the KMT decided to undertake a more assertive action on the afternoon of June 28th, to stand up for its solemn responsibility as an opposition party, loyal to this country, and to try whatever it can to get President TSAI back on track!

On the late morning of June 29th, the DPP legislators that outnumber the KMT’s have been entering the Chamber in order to seize the control over the Chairperson’s podium. The KMT accuses the DPP legislators for inappropriately forcing the KMT legislators out of the Chairperson’s podium. Regardless of the result, the KMT will insist on the removal of CHEN Chu from the list and block President TSAI’s ‘pork barrel’ nomination for the Control Yuan members for the good governance of the country.
