國民黨對於中共人大常委會通過「港版國安法」深表遺憾
支持港人治港,高度自治

6月30日中共人大常委會以全票通過《香港特別行政區維護國家安全法》(俗稱「港版國安法」),本法由中共當局強勢主導,排除香港立法會參與,在欠缺社會溝通的情況下強行立法通過,已然引發部分港人不安。國民黨對此深表遺憾。

如今港版國安法六章六十六條的內容已公告,中共當局透過該法強勢展現所謂「一國兩制」中,對於「一國」的堅持,但維繫香港發展關鍵之「兩制」精神則受到嚴重壓縮,這個發展趨勢必然會對香港前途埋下更多不確定因素。國民黨嚴正呼籲,《香港基本法》原則上將國安立法授權香港自行制定,此次立法已無回頭之可能,然未來仍有待香港自行立法或修法,方符合中共當局對於香港所作「港人治港、高度自治」的承諾。

國民黨認為,不能因為政治因素而犧牲香港發展的特色與港人自治的空間。香港所擁有的自由空間正是其幾十年來快速發展的主要基礎。港版國安法規定香港政府應採取必要措施,加強宣傳、指導、監督和管理有關國家安全的事項,恐有過分干預港人言論自由之。執法過程中,若不能充分尊重香港執法與司法的自治空間,不能確保港人的基本人權,無疑將扼殺香港發展,斷送港人前途。

針對港版國安法訂立的分裂國家、顛覆國家政權、恐怖活動、勾結外國或者境外勢力危害國家安全等罪,國民黨呼籲中共當局,務必運用智慧、自我克制,不要介入香港地區國安法執法過程,更應避免干預香港地區司法獨立,使得原本「港人治港、高度自治」,從勉強維持雙贏走入兩方皆輸的局面。國民黨也呼籲港府和香港立法司法機構都能堅定捍衛香港高度自治,維護自由傳統。

國民黨提醒,無論是港版國安法,或者早在2009年便通過的澳門《維護國家安全法》,均適用於在各自地區或在各自地區註冊的船舶或航空器內,所作出的「違法」行為。港版國安法還規範到「不具有香港永久性居民身分的人」,在香港以外針對香港進行該法規定的「犯罪」行為。因此,國民黨特別要求無法妥處兩岸關係民進黨政府,仍要窮盡一切可能以保障台灣人民的基本權利與人身安全,避免因中共當局或港、澳官員不當或過度執行前述法律而受到影響。

國民黨立院黨團為支持港人在基本人權保障下,爭取民主自由的努力,曾提出對於港人庇護規範的具體修法提案,但遭民進黨阻擋。國民黨認為,我方大陸委員會「香港人道援助關懷行動專案」和目前設立的「台港服務交流辦公室」,與蔡英文總統在大選前對香港民主運動的強烈關懷相比,顯然程度有別,讓人認為有「打假球」之嫌。

最後,國民黨強調,中華民國是依國父三民主義所創立的主權國家,更是亞洲第一個廣受承認的民主共和國。「一國兩制」在香港的發展,更證明了中華民國民主憲政體制的優秀和對台灣的重要。中共應確實體認到「一國兩制」在台灣並無市場,以及中華民國已在國際上存在一百零九年的事實,以對等協商的和平方式處理台海兩岸主權爭議。

KMT Expresses Regrets Over Mainland China’s Adoption of Hong Kong National Security Law

On June 30, Mainland China unanimously adopted the “Law of the People's Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region”, or dubbed the “Hong Kong national security law,” a move that unsettles many Hong Kong people as the law seeks to greatly restrict their freedom.

The KMT regrets Beijing’s decision. The following is a KMT statement on the issue.

1. Hong Kong has implemented the so-called “one country, two systems” formula as promised by Beijing since 1997. However, Beijing dominates the Hong Kong security law with lots of measures ostensibly designed to safeguard “one country” only, while greatly dampening the spirts of “two systems,” which is more essential to Hong Kong’s self-ruling and future developments. The KMT urges Beijing not to sacrifice Hong Kong’s developments or undermine the self-ruling basis in Hong Kong for hidden political agenda.

2. The KMT urges Beijing not to interfere with the Hong Kong authorities in implementing its national security law so as to maintain Hong Kong’s judicial independence. Most importantly, Beijing should respect the principle of “Hong Kong people ruling Hong Kong with a high degree of autonomy” and prevent a no-win situation from happening.

3. We are aware of the fact that the Hong Kong national security law covers not just Hong Kong residents but also anyone living abroad. That is, the law might criminalize anyone outside of Hong Kong as long as he/she is deemed in violation of the law. In light of this, the KMT urges the DPP government to do its utmost to safeguard the basic rights and personal safety of Taiwan people from the possible, improper enforcement of the aforementioned law either by Beijing, or Hong Kong, or Macau authorities.

4. The Mainland Affairs Council under the DPP government announced Hong Kong Humanitarian Aid Project and later established the Taiwan-Hong Kong Office for Exchanges and Services to provide necessary assistance to Hong Kong citizens in response to Beijing’s imposition of the national security law on Hong Kong. However, the KMT thinks that the DPP government is providing nothing but lip service in that regard as the above-mentioned efforts by the DPP government greatly pale in comparison to those made by President Tsai Ing-wen in a response to Hong Kong’s democratic movement prior to the ROC Presidential election last year.

5. Finally, the KMT believes that the recent developments of the “one country, two systems” formula in Hong Kong only demonstrates the superiority of the ROC’s constitutional democratic system and its paramount importance to Taiwan. Beijing should realize that the “one country, two systems” formula definitely earns no place in Taiwan. Beijing should peacefully deal with cross-Strait disputes over sovereignty through consultations on equal footing.
