國民黨:監委不該是政黨打手!

上週國民黨立法院黨團以突襲的方式佔領立法院議場,以實際的行動,明確的表達撤回陳菊等人的監察院委員被提名名單。

國民黨團此舉,是為了要凸顯這份史上「最綠、最爛、最酬庸」的名單,同時也擔憂這份名單通過之後,監察院將成為中華民國位階最高的「東廠」,成為執政黨的政治工具。消滅東廠、撤回提名才是抗爭重點。

國民黨進一步指出,從陳師孟以針對法官審理案件的法律見解、心證及事實認定等審判核心事項為由,擬約詢判前總統馬英九洩密案無罪的法官唐玥,嚴重違憲行使調查權,引起法界譁然;高雄氣爆善款糾正案,蔡系監委全面護航;到高涌誠、蔡崇義兩位監委要求檢察官陳隆翔重新起訴「曲棍球協會詐領補助款案」,並要脅「不解決,就是逼我們彈劾」。顯見監察委員在職權上,已經失去了超然中立,成為政黨打手。

而此次的監委提名,27人中,24人具有民進黨背景,比例高達九成,其中院長提名人陳菊更是民進黨創黨元老,而陳菊在高雄市長任內,她所領導的市府團隊遭到監察院調查58案,糾正案30案、彈劾案3案,由這樣具有政黨色彩且極具爭議的人來擔任監察院長,確實不妥,也加速監院「全面東廠化」的可能。

國民黨認為,民進黨今天提出的監委名單,是玷污憲法要求監委必須超出黨派獨立行使職權的精神。民進黨既然主張廢考監,當然就不應該繼續提名監委,撤回提名才是彼此最大的公約數。


KMT: The Control Yuan Must Not Become a Partisan Political Weapon

Last week, the KMT legislative caucus went on a surprise offensive, occupying the Legislative Yuan chamber and taking concrete action to unequivocally call for the withdrawal of President Tsai’s nomination of Chen Chu and other DPP partisans to the Control Yuan.

By occupying the Legislative chamber, the KMT caucus sought to bring attention to the most corrupt example of political cronyism in the history of the RoC. Furthermore, the KMT caucus is concerned that if Tsai’s partisan nomination list passes, the Control Yuan would thus become a modern day dongchang—the Ming Dynasty era secret police—with nearly unlimited power, an oppressive tool of the ruling party. The main goals of the KMT caucus’ protest are to call for the withdrawal of Tsai’s nominations, and to eliminate the possibility of the Control Yuan becoming a dongchang.

The KMT would further like to draw attention to the following three cases, in which DPP affiliated Control Yuan members have acted as partisan political weapons:

1) Control Yuan member Chen Shi-meng (陳師孟) committed a serious abuse of constitutional power, causing an uproar over the boundaries of the law, when he attempted to summon Judge Tang Yueh (唐玥), who had acquitted former President Ma Ying-jeou (馬英九) of leaking classified information at the Taipei District Court, in order to investigate the core issues of the trial, including Tang’s legal opinions, inner convictions, and determination of facts.

2) Regarding the Kaohsiung Gas Explosion Incident of July 2014, Control Yuan members loyal to Tsai defended then Kaohsiung mayor Chen Chu’s (陳菊) administration after the Control Yuan issued corrective measures against the administration for its misuse of donations for victims of the incident.

3) Control Yuan members Tsai Chung-yi (蔡崇義) and Kao Yung-cheng (高涌誠) demanded that public prosecutor Chen Lung-hsiang (陳隆翔) reopen the case against the RoC Hockey Association for receiving government subsidies through fraudulent means. The two Control Yuan members went as far as threatening the prosecutor, saying that if Chen failed to give in to their demands, they would pursue impeachment against him.

With these cases in mind, it is obvious that Chen Chu is far too partisan and controversial to serve as president of the Control Yuan. Not only do 24 out of 27—almost 90%—of the nominees to the Control Yuan have a DPP background, Chen, the nominee for presidency of the Control Yuan, is actually one of founders of the DPP. Worse, when Chen served as Mayor of Kaohsiung, the Control Yuan investigated her administration a total of 58 separate times, including 30 corrective measures and 3 impeachment hearings. Under the partisan and controversial Chen, the Control Yuan would accelerate towards becoming another dongchang.

The KMT believes that the DPP, with this Control Yuan nomination list, has sullied the spirit of the RoC Constitution, which stipulates that the Control Yuan shall exercise its authority independently and without partisan considerations. Furthermore, since the DPP has continuously advocated for the abolishment of both the Control and Examination Yuans, the DPP should not have continued to nominate members to the Control Yuan. The withdrawal of the nomination list is the largest common denominator between the KMT and the DPP.
